Commissioned Reports
A report assessing the legal and economic framework for licensing copyrighted content used in AI training, with particular focus on the EU. It explains why compulsory or mandatory collective licensing would be legally risky, difficult to reconcile with the Berne Convention and the three-step test, and economically unsound, drawing on decades of empirical evidence. It recommends instead supporting voluntary licensing in its various forms.
